June 16 (Bloomberg) -- Hewlett-Packard Co. sued Oracle Corp. over claims that in a period of eight months Oracle went from partner to "bitter antagonist" and has breached its contract. The lawsuit, filed yesterday in state court in San Jose, California, cites Oracle's hiring of Hewlett-Packard's former Chief Executive Officer Mark Hurd last year and Oracle's March announcement that it would no longer support its database software on Hewlett-Packard computer servers that use the Itanium chip. Oracle (NASDAQ:ORCL) issued a statement claiming that Hewlett-Packard (NYSE:HPQ) knew all about itanium end-of-life plans before the company found out. The company stated, "We believe that HP specifically asked Oracle to guarantee long-term support for Itanium in the September of 2010 agreement because HP already knew all about Intel's plans to discontinue Itanium, and HP was concerned about what would happen when Oracle found out about that plan. What we know for certain is that Ray Lane and HP's current board members and Leo Apotheker and HP's current management team now know full well that Intel has plans in place to end-of-life of the Itanium microprocessor. Knowing this, HP issued numerous public statements in an attempt to mislead and deceive their customers and shareholders into believing that these plans to end-of-life Itanium do not exist. But they do. Intel's plans to end-of-life Itanium will be revealed in court now that HP has filed this utterly malicious and meritless lawsuit against Oracle." Oracle has a potential upside of 20.7% based on a current price of $31.16 and an average consensus analyst price target of $37.61.

Oracle (NASDAQ:ORCL) said that it will cease all efforts to develop technology around Intel's (NASDAQ:INTC) Itanium chip, which reportedly took Intel and Hewlett-Packard (NYSE:HPQ) by surprise. The company said its decision on the chip came after multiple conversations with Intel senior management, which made it clear that their strategic focus is on their x86 microprocessor and that Itanium was nearing the end of its life. HP issued a statement saying, "We are shocked that Oracle would put enterprises and governments at risk while costing them hundreds of millions of dollars in lost productivity in a shameless gambit to limit fair competition." Oracle has a potential upside of 14.6% based on a current price of $31.41 and an average consensus analyst price target of $36.

A US judge has slammed Oracle for using "extreme, unnecessary, overheated rhetoric" in its latest submission in an ongoing court battle with HPE. Elizabeth Laporte, US magistrate judge in the court of the Northern District of California, this week issued an order (PDF) admonishing Big Red for its "tit for tat" retaliation in the case. The dispute began in 2016, when Oracle filed a suit against HPE for improperly partnering with maintenance biz Terix Computer to sell third-party support for the Solaris operating system. Oracle argued only authorised partners can support the OS. Oracle had also won $58m from Terix the prior year over similar claims, having said the firm violated copyright by providing third party support. HPE tried to have the case dismissed, but this motion was denied last January when a district judge said Oracle had "plausibly stated a claim for vicarious copyright infringement". Last month, the parties to the case filed their 24th discovery dispute letter – used to obtain evidence from the other party – in the case, which related to alleged spoliation by Oracle. However, Laporte said that, having reviewed the letter, the court was "very disappointed by the extreme, unnecessary, overheated rhetoric employed primarily by Oracle". Phrases that were deemed less than appropriate included the opening salvo: "Time and time again, HPE and its counsel have shown that there is no game they will not play in the pursuit of misperceived litigation advantage..." and other phrases. These included "blatant gamesmanship", "knowingly misrepresenting facts in an attempt to slander", "empty accusations", "supposed grievances" and "nonsense". Such language did not comply with the district's guidelines for professional conduct, which state that written materials submitted to the court should "avoid denigrating the intelligence, ethics, morals, integrity or personal behavior of the opposing party, counsel, or witness, unless such matters are at issue in the proceeding". Oracle's lawyers have been ordered to pass a copy of the order of admonishment to their client, with the judge stressing that "this inappropriate language must cease immediately". Elsewhere in the letter, the judge also criticised Oracle for focusing on issues that aren't relevant to the specific discovery dispute and for suggesting it will respond to a motion of spoliation with one of its own. "Apparently in the mistaken belief that the best defense is a good offense, Oracle devotes almost a full page to a lengthy footnote that does not concern the current dispute but instead concerns purported discovery failures by HPE," the judge wrote. "Discovery motion practice should not be an exercise of 'tit for tat' retaliation." Oracle has also been instructed to respond to previous court orders, made last October, by 10 April. Developed under the code name of Merced , Itanium and its underlying architecture are expected to provide a foundation for the next-generation of software for the server and high-end workstation markets. Intel plans to follow Itanium with additional IA-64 microprocessors, which have the code names of McKinley, Madison, and Deerfield. In addition to supporting a 64-bit processor bus and a set of 28 register s, the 64-bit design allows access to a very large memory (VLM). In addition, the architecture exploits features in Explicitly Parallel Instruction Computing ( EPIC ), a joint Intel and Hewlett-Packard development effort. These provide advances in the parallel processing handling of computer instruction s known as predication and speculation . An additional Itanium feature includes a Level 3 (L3) cache memory , to supplement the current L1 and L2 cache memories found in most of today's microcomputers.
